Just in.....according to news sources on our local TV station this AM the press conference today is to disclose that JR and Patsy passed their polygraphs, but there were on officials from either BPD or FBI present. BPD said that this is not acceptable...they will only accept if an FBI official was pesent during the polygraph. My guess is they read "How to Pass a Polygraph" and studied for 3 years till they could pass....this is a NO BRAINER. They've said that the Rams had no law enforcement officials present. And some of what I've read on the other threads leads me to believe that the Rams were pumped full of drugs. If they refused a urine test with one examiner, then the examiner they went with obviously didn't test for drugs. I can't even begin to describe my utter contempt for these people. This is sure to sway a future jury pool. Let's face it folks. They've gotten away with cold blooded murder. But... You only think you've gotten away with murder. And the deeper you dig, the harder it will eventually be to get out of that hole. The more you think that this is a murder that will fade away, the more you'll have to accept what you have done. BODY: JACK MARTIN, Jewell's Attorney: Mr. Jewell is a little bit more confident of the integrity of the law enforcement people than perhaps I am, from my experience. He expects he'll be exonerated, he expects his innocence will be borne out, he expects that the evidence will show that he had nothing to do with this. And he's confident that that will happen. As an attorney, I'm much more cautious. REPORTER: Why hasn't he come and spoken to us? That's what I want- JACK MARTIN: Because I told him not to. And any lawyer worth his salt would have told him not to. I'm not- I might as well go over to the State Bar and turn in my bar license if I put him out to be interviewed by every one of you people. I know I'd be drummed out of the criminal defense bar, and I would never get another client in my life if I did that. It would be foolish to do that. He's talked to the FBI, he's talked to the media, he's told the truth, and it's not time to be harassed by every one of you. REPORTER: Mr. Martin, has there been any offer of financial assistance for his legal defense? JACK MARTIN: No, not yet. The lawyers that have been involved in this case have done it on a pro bono basis. Who knows what might be available to him in the future? No. REPORTER: What about his career in law enforcement? What are his plans- JACK MARTIN: I mean, it's- The way he's been treated, it's ruined, isn't it? I mean, unless he's exonerated, unless it's brought out that he really did the right thing, if all the law enforcement people are there that day, partly because him and Tom Davis [sp]- I don't want to minimize the efforts of Tom Davis, the GBI agent. It was Tom Davis and Richard Jewell who identified this bomb. It wasn't just Richard Jewell. Let's remember that. Tom Davis, the GBI agent, and Richard Jewell, operating as good law enforcement agents, saw something that they suspected, and turned it over to the people they should have. It's those two gentlemen who did the right thing. You know, one thing that worries me - the way that Mr. Jewell has been treated in this thing, the next time somebody sees a suspicious package like that and they want to turn it over to law enforcement, and do the right thing, I wonder - I hope - I truly hope that they don't hesitate to act for fear that - 'Wait a second, I'm going to be the suspect.' 'If I work, and do the right thing.' I hope that doesn't happen, and, I mean, Mr. Jewell hopes that doesn't happen. Mr. Jewell hopes this nightmare is over and he can get on with his life, and get on with things. REPORTER: Mr. Rackleff, just to clarify a couple of questions that came earlier, or simplify it if we could - in your career, have you ever been wrong? DICK RACKLEFF: [chuckles] I probably have. I'm human. REPORTER: On polygraph exam? DICK RACKLEFF: I probably have. JACK MARTIN: Anybody want to see another [unintelligible]- DICK RACKLEFF: If that was a habit, I'd get out of the profession. JACK MARTIN: I mean, of course he's probably been wrong - I mean, but he's seldom wrong. This is all we can do. We've got the best man in town. We're not- We didn't get the man or the person who does the 30-minute exam, you know, and moves on to the next one. We got the person who takes time, he does it the way the law enforcement people do. And, you know, I guess you're damned if you do, damned if you don't. He says he didn't- doesn't believe he had anything to do with it, he didn't do it. He could have made a mistake in the exam, but he doesn't believe he did. And I don't either. REPORTER: Can you say, you know, Richard scored a 10 out of a 10, or he's an eight out of a 10, as far as how well he performed on a test? DICK RACKLEFF: He was non-deceptive. As far as probabilities, if you're asking about probabilities, the visual information, computers do that. They have their ranges. The research have that. Basically, it's non-deceptive or deceptive, and he was inclusively non-deceptive. REPORTER: [unintelligible] DICK RACKLEFF: That's the final results. As far as going over all the visual information, that's extensive. I'll be glad to do that at some- at some- REPORTER: What is the margin for error? JACK MARTIN: We're going to have to close it down now. REPORTER: One- one more question. Are you going to file to unseal the search warrant? JACK MARTIN: You know, I've been busy doing things that matter more than that damn warrant. Everybody- Y'all- All- Y'all want me to get that search warrant affidavit, and we'll get to that. The most important thing for me to do was to talk to the people who were actually in the park that night, to walk that walk, to hire good people like this, to do an examination. We'll get to that search warrant affidavit. I know y'all are interested in it. I'm sort of interested in it. I don't think there's much in it, quite frankly, but probably when we get it we'll find out how little it takes to search your house in America, and everything else you own. But we'll get it. We'll do it next week. You know, we got- We're not- We're doing this for nothing. I actually have some other cases, and I've been busy on those. There's case law on it. My nephew, who's my law clerk is- had to go look up the cases. So, he's looked the cases up. We'll file the motion, and we'll get it for you, but we're going to do other things first. We're goin'. REPORTER: Jack, you mentioned that they don't have one shred of hard physical evidence. JACK MARTIN: Not that I know of. REPORTER: Well, is that- JACK MARTIN: Do you know of any? REPORTER: Is that your opinion, or do you know for a fact? JACK MARTIN: The FBI is not revealing everything to me. I do not have access. I am not in their labs with them. I just assume if we knew of something, we'd know by now. Your guys probably have better access than I do to what the FBI is thinking. But I haven't seen one shred of hard evidence. And I do know that if they had a fingerprint or they had a hair match, we wouldn't be having this news conference today. I do know that. Thank you. BOBBIE BATTISTA, Anchor: Sounding angry and a bit frustrated, attorney Jack Martin calling for the FBI and the media to stop harassing and investigating his client, security guard Richard Jewell, who remains the FBI's one and only announced suspect in the Olympic Park bombing back of July 27th. Also, talking to the media today, Richard Rackleff, who is a former FBI agent and now an expert on a lie-detector test, telling the press that he had spent 15 hours worth of time on August 4th and August 15th, doing extensive tests and pre-interviews to test with Richard Jewell, that Jewell passed all of the tests in which he emphatically denied any knowledge of the July 27th attack. And Rackleff said that he would stake his reputation on that. Two civil attorneys newly hired by the security guard also have said that they are now looking into the possibility of suing the FBI, the news media and others over the way Jewell has been treated. Posted by Chris on 06:01:39 5/24/2000 HEADLINE: Former G-man keeps himself in hot pursuit of the truth Retired FBI agent Rackleff appointed to state Board of Polygraph Examiners BYLINE: By Mara Rose Williams STAFF WRITER BODY: Richard Rackleff knows the truth when he sees it. He's spent half his life separating the honest from the dishonest, first as a special agent for the FBI, then as a polygraph examiner for the bureau. The 53-year-old Norcross resident recently was appointed by Gov. Zell Miller to the state Board of Polygraph Examiners. "His appointment to this position is in the public interest," said William Hinshaw, special agent in charge of the FBI in Georgia and a former colleague. "Polygraph is a technique that should be regulated by people who understand it - by people who appreciate its shortcomings and are sensitive to the possible benefits of it." During a typical polygraph test, the examiner asks a series of questions. As the subject answers, physiological changes, including cardiovascular responses, breathing and skin reflexes, are registered. "The good Lord didn't make it easy for us to lie," Mr. Rackleff said. "The stress associated with deception affects the automatic functions of the body. With proper test questions you should be able to determine if there is deception or not." After 27 years with the FBI, Mr. Rackleff retired in November 1990 and started his own business, Federal Polygraph Associates. "I work every day on cases for attorneys, both prosecutors and defense attorneys," he said. "I work with corporations and security firms." As one of six members of the state polygraph board, Mr. Rackleff is charged with monitoring the integrity of other examiners. The licensing and regulatory board reviews complaints against examiners and is responsible for making sure tests are given fairly and within the guidelines of the Georgia polygraph law. Mr. Rackleff said he has "a great deal of confidence" in the results of polygraph tests, despite controversy over whether they really can determine if a person is telling the truth. His work with the FBI put him in a position to meet some of the nation's most infamous criminals. He met convicted killer Wayne Williams on the evening in 1981 when he was arrested on suspicion of killing several Atlanta children. In a five-hour, one-on-one session, Mr. Rackleff probed into Williams's life and asked about the killings, Mr. Rackleff said. "The results of Williams's test show definite deception and indicated he was involved with the death of at least one victim," he said. He added that as a professional polygraph examiner, it is not his place to judge a person's guilt or innocence. Test results were not used in the Williams trial, officials said. But polygraph results may be admitted as evidence in a trial when both the prosecution and defense agree to a test, regardless of its outcome. "The FBI believes that polygraph is a very sensitive technique. We use it sparingly and in conjunction with an investigation rather than as a substitute," Mr. Hinshaw said. "There has always been a longstanding saying in the FBI that the three most important parts of the polygraph is the examiner, the examiner and the examiner." "I really enjoy polygraph," Mr. Rackleff said. "When I retired I considered g etting out of it. But I'm really glad I stayed." But Mr. Rackleff said the job also has its tensions. For example, he said his meeting with Williams was one of his most interesting and most stressful. "There is no question when you are doing an exam like that you are going to feel pressure." Neither was he a member of any board or certified polygraphers. Peter said, "Sort of like a dentist working on you who had never finished dental school...?" And the expert answered "Yes." Sorry, I didn't catch his name. He also said that questions should have been asked to the police and that the person administering the test should have very intimate details of the case known only to the killer so that he could ask about such things. The public was very vocal about OJ Simpson and, as a result, many clubs and restaurants made it clear that OJ would not be made to feel welcome in their establishments. This side show is the latest Ram PR event and I, for one, think it's appalling and disgusting behavior and they should not be "made to feel welcome." If they wanted to take a respectable polygraph test, they should have done so with the FBI. The guy they used has absolutely no credibility after the Ainsberg fiasco. They sneak off to take a test and only admit to taking one AFTER they learn the results. They refused drug tests. And, most outrageously, they are conducting a TWO HOUR PRESS CONFERENCE! This is absolutely unheard of and unbelievable -- this information could have been released in a press release. No one holds a two-hour press conference. This is just their way of getting two hours of airtime to present their side show without having to cough up any money to finance another Crock. I write on a forum which discusses the murder. Our purpose is to make sure that justice is served in regards to JonBenet. The writers on the forum are intelligent people who don't believe the media circus around the Ramseys for a minute. I would like you to visit the forum and read for yourself. One of the regular posters there is Steve Thomas, the detective who wrote the book about the case. I would like to ask you, since you are a champion of children, whether you would have Steve on your show, and whether you would consider doing an entire show on this topic. I realize it is very controversial. But today the Ramseys are holding a press conference to announce, among other things, that after three years they have finally passed a lie detector test. What they are failing to say is that they refused to take the required urinalysis test to show they are not being inflenced by any drugs, and they refused to take the test from a certified FBI polygrapher. Rather, they hired someone independently, and many people feel they have been coached and given practice tests, and only would reveal to the public if the test was passed by them. I will give you the website address of Justice Watch, and I challenge you to read on it when you can, and do whatever you can to make sure that these people do not get away with the abuse and murder of this little child. I know that it is taking a chance to buck people like the Ramseys. Barbara Walters and Larry King were far too easy in her interviews with them.
