JR was doing the Secret Service routine, throwing himself in front of the bullet. Too bad we couldn't put a muzzle on him. The paintbrush question was the best. I want to begin...she runs the finest website...we call her Mrs. Brady... Ma- Good morning. PB - You are the consumate R watcher. Ma - The classic was when PR snarled. It was one of her "don't go there" moments. PB - She snarled at Haney.., Ma - I thought the true Patsy came out. Was Lin Wood off-camera motioning to them? PB - Part of what came down...are you making the commitment to meet with the BPD. Ma - They were setting up parameters on the meeting. PB - ST got them admit they've never been to the poice station...ever...LK was shocked. Ma - Larry did a great job. PB - We've seen them do this before..PR wishing they'd been arrested...remember when JR said he wished they'd been indicted. Were they praying to be indicted? MA - In their book, DO Intelligence. She made two major slipups. That she would get a free and fair trial. About the ransom note writer...first it was "he", and then it was "she". Ma - At least they didn't bring up the dead killer last night. PB - They hit a home run last night. ST says I think you're good for it. Caller - The rest of the country wants to hear the evidence. What about the pineapple? PB - I thought those things as well. Caller - ST had a huge audience, and he didn't do it. Ma - He's very circumspect about the actual evidence. Caller - When little child has a vaginal infection...JR was so definite...about "our pediatrition"... PB - When they passed on the evidence at the big get-together, there were many who thought JBR was sexually molested. Ma, do you feel that way? Emphasizing, convictions can be obtained on circumstancial evidence. CW - There's another case, another where the victim's body hasn't been found, the athiest Madelyn Murray O'Hair (I knew her husband Dick O'Hair) The point I'm making is, that the idea you don't go forward in a case if you don't have witnesses, obvious evidence...the obvious cases are plea bargained..the cases that go to trial are the circimstancial cases. From the standpoint of the DA office, is there a justifiable basis to go ahead and charge? Do you have the ransom note? Do you have the piece of pineapple? What about PR wearing the same clothes? My god, is there anybody out there with any intelligence, who believes anybody else would not have had murder charges brought against them? Any coroner or Medical examiner will tell you about cases like this one, where there was not a great deal more, look at the Louise Woodward case, there was a broken wrist made three weeks earlier, there was evidence that went away from her. Sullivan was decided by the U.S. Supreme Court. Prior to that there was a general recognition in the common law of a qualified privilege (a protection from being held accountable for something otherwise defamatory) in defamation actions, for "fair comment" upon the conduct and qualifications of public officers, like Alex Hunter. While the existence of this privilege was undisputed, there was disagreement as to whether it applied to only comment or opinion or whether it also applied to misstatement of facts. The Sullivan case came out of a racial disturbance in Alabama. The New York Times published a paid advertisement, signed by a number of prominent individuals, complaining, among other things, of the conduct of the police in handling the situation. The Chief of Police, Sullivan, filed a lawsuit claiming that he was defamed by the advertisement. At the time, Alabama law held that you could have the protection of the privilege only if your statements were opinions. However, Sullivan was able to show two misstatements of fact and the jury then returned a verdict in favor of Sullivan. The case was appealed all the way up to the U.S. Supreme Court. The U.S. Supreme Court reversed by holding that the 1st Amendment confers a qualified privilege which is not limited to comment or opinion, and which extends to false statements of fact, provided that they are made without "malice." Malice can be found if the statements are made with knowledge that they were false or with reckless disregard of the truth. In 1967 the U.S. Supreme Court extended the constitutional privilege. The case was Time, Inc. v. Hill, and it extended the privilege to cover further publicity to already public figures, and to cover news regarding matters of a public interest. A public figure is defined as a person, who by his accomplishments, fame, or mode of living gives the public a legitimate interest in his doings, his affairs or his character. One can be included in this category by appearing before the public - such as calling press conferences. Three things are looked at: 1) did the person seek publicity and thereby consent to it, 2) are their affairs already public and therefore no longer regarded as private, and 3) the matter is of a legitimate matter of public interest - say a D.A. who works harder for the criminal than the state. Based upon these cases, it would appear that Steve Thomas' statements (both written and spoken), even if inaccurate, are privileged unless they were made with knowledge of falsity or in reckless disregard of the truth. It seems doubtful that the Ramseys could make such a showing especially since Thomas published their side of the story complete with Lou Smith's theory. When I re-read the "report", I realized I apologized for lack of speed about four times. Oh well...there was so much critical info and discussion... By the way, the "long-time" forum members probably remember this, but people who have joined recently may not know the origin of the "Boyles Reports". For awhile I was taking a few notes on the show and posting them on my lunch-break, until the day Lacey posted the "and hence" theory here on the forum. A week or so later, I woke up hearing Peter say how he and McKinley had come up with this linguistic comparison between the ransom note and the Ram's previous year's Christmas note, going into the "and hence" etc. theory verbatim. (I call it the Lacey-Cat Theory...which will be used in a trial if there ever is one, IMO) (Lacey, straighten me out...between you and Catherine, who came up with "and hence" and who came up with the further detailed refinement...I THINK you had the original idea...right?) As a GIGANTIC Peter Boyles fan since he first was on the air on KWBZ in the 70's, I was kind of stunned he was taking credit for a theory which was first posted on the forum. That morning I got up, logged on, and started "transcribing". That's why Lacey sometimes jokes about Peter getting his ideas from the forum. In any case, I started doing pretty much the same as today's report for a few months, and then, lo and behold, a wonderful lady named Panico came along. She was much faster with her fingers than I, and was able to continue the transcriptions when I had to leave for work. For many months, we would both be transcribing like crazy, often at the same time, covering similar and sometimes differing aspects of what was being said on the air. When I took my daughter to LA for two weeks, Panico took over completely, and from then on, I was sort of her early morning assistant. Before long, Panico was transcribing both the "as it happens" stuff, and then actually typing it up later in the afternoon word for word. Then along came RealAudio, and I was able to "retire", in addition to there being a major slow-down in case news. I would occasionally post, and sometimes lurk, for quite awhile. Even though I was well aware Panico had cancer...the intitial discovery, chemo treatments, etc., were documented on this forum as she went through them....but through it all, she still kept posting and transcribing. When I logged on one day to check out reactions to some minor case news or other, I was STUNNED to read that Panico had passed away. The forum would never be the same. There is no way I can do the transcribing every day...I'm a single parent who works full-time and goes to school full-time as well. I did a few in honor of Panico, THE official Justice Watch transcriber, and will continue to do it whenever possible, especially on "big story" days. Thank God for RealAudio, so at least people can hear the Boyles show now. In the early days, doing it was much more critical to the case followers. Mrs. B and Chris...thanks for your hard work!
