One thing I have never found Steve Thomas to do and that is lie. Never. Granted I have only read his book and watched him on TV but I have never once thought Thomas was lying or changing his story. Unlike the Ramsey interviews where I am usually screaming at the TV because of all the stupid out right lying they do. So I feel confidant that Monday's court date will just prove what I have felt all along: Steve Thomas doesn't need to lie. Ever. Thomas always has the truth on his side. He is that kind of guy. They are routinely required to appear in court, and grow to know the nuances of service well. If Steve Thomas says he wasn't served, I think he'd certainly be in a position to know whether or not he was legally served. Here's what I could find regarding the service of summons and Colorado law (from the COLORADO RULES OF CIVIL PROCEDURE): (d) By Whom Served. Process may be served inside or outside this state by the sheriff of the county where the service is made, or by a deputy, or by any other person over the age of eighteen years, not a party to the action; (e) Personal Service. Although I understand Mr. White's frustration, you just can't thumb your nose at the court like that. I wouldn't be surprised to see White get a few days in jail. I give you fair warning henceforth close attention will be paid to what is said before this court will be weighed heavely againt the criminal statues re perjury. Keep in mind Mr. Thomas that the court is 99% certain that you WERE served, but not 100%. The Burden of proof is now upon YOU to fully enlighten this court as to the fact and circumstances surrounding THAT PERSON. The court feels that you deserve this continuance so as to give you every conceivable chance to extricate yourself from this legal entanglement. I don't believe he will use any sort of technicality to skirt the law. You know one of those type of technicalities that make us roll our eyes and go "yeah right". Kind of like the Ramsey lie detector fiasco. Thomas just doesn't seem like that kind of guy. However if the judge thinks that Thomas is using a technicality to avoid getting in trouble than I am sure the judge will come down hard on Thomas. I don't know what really went on other than what has been printed as fact. Such as Thomas says he wasn't served properly and wants the person who claims to have served him sanctiond by the court. However since Thomas is a stand up guy I don't think this is an itty bitty, dance around interpretation of the word properly. Honey chile!! when I realized that I was way way above average in intelligence, I could have gone in any direction to make money. Making money was not the reason I went into farming. I went into farming because of my love for being "close to the earth and animals". The same holds true as to the reason I opted for the avocation of worm farming on retirement. I KNOW how to read the market trends and reports and I KNOW how to get the most from my invested capital. It would not surprise me in the least to learn that I have more money in the bank than Petrocelli(sp),Lin Wood, and Johnny Cochran (combined). Why on Earth should I have become a lawyer. Yes, my son-in-law is a lawyer and a darn good one I might add. He claimes that I have taught him more commom sense as to how the law really works than he could ever learn in 20 years of practice. I have read, read, read and still read about the law. I have served on half a dozen Grand Juries and at least that many Petit Juries in my county. I have been sought out for advise by lawyers, believe it or not. Some litigants have bent over backward to settle upon being told there was a possibility that I would be called as a witness. Everyone knows that I "ain't" gonna say anything I can't back up. Some people say that they don't even like to see me in a courtroom.........I have even been requested to be in the courtroom just so certain witnesses can see me looking and hearing their every word. I am not a "mafioso" type person. I am just a VERY concerned citizen for the proper direction of the American system of jurisprudence. Should you ever spy a heavy set 70+ man in overalls with a flat-top crew cut in the booth or table next to you at a Dennys, you could very well be looking at old Ellique. Why don't you walk over and tell him hi. If my wife is with me you will recognize her by her charm and impeccably coifed natural silver hair and her precisely matched befitting attire with fine but not too gaudy jewelry. We are all about enjoying our golden years all over the World and just may be spotted anywhere. We are not pretentious. We are just your everyday people who doesn't have to worry about impressing anyone. If we have been to a special gathering or some other function such as a play or concert and we are at a Dennys, chances are you will see me in a good looking suit or a tux (yuck) with my tie loosened. That was not per year that was a final settlement! I refused to give up my medical so they haven't had to pay me anything beyond the piddly amount they had payed prior to demanding a settlement. Yes, they "re-educated me." I still can't get a job. No one wants to hire you if you have filed a worker's comp claim and yes, that's illegal but try proving that or the fact that you are handicapped is why you didn't get the job. So Janov, sum total (re-education, medical to date, "wage loss" etc.,) worker's comp has paid me over almost 2 years is less than half of one year's salary for me. If I ever take another job where I use my hands I have to pay that back by the way. Tell me any job you know of that doesn't require the use of your hands. Do you really want to keep making this accusation against Steve? If so, let me tell you about a refinery worker in Calif. who was killed on the job. Worker's comp initially offered his wife $24,000. And, it really doesn't pay sometimes to get an attorney (depending on what the injury is) because, you're right, the attorney gets a lot from the person turning in the claim. A lot of people don't realize (at least this is so in Nebraska) that they are only allowed a certain percentage of their salary if their injury is work related, and they think they are going to get more if they sue. It's not like a car accident. You don't get any pain & suffering. If a doctor gives you a permanancy rating on a body part that is injured in a work-related accident, that is what the insurance company must pay.
