I'm glad someone has finally stood up and mouthed the truth. The Grand Jury was NOT allowed to take a vote. We all thought this was the case and now here's someone with an inside track saying this is exactly what happened. We could hear it in that weasel's well framed GJ aftermath speech. No vote! Okay, now I want the Ramseys to shut their fat faces when it comes to the Grand Jury NOT recommending that charges be filled against them. This has been a major part of that "Innocent Banner" these people have hoisted since the GJ was shut down. "No vote" means the Grand Jury very well may have WANTED charges filed against the Ramseys but were deprived the opportunity to ask for them. And this after all their hard work. "a couple of things" Posted by fly on 11:15:16 7/27/2000 First, I'd like to know when Hunter told the police he wouldn't ask the GJ to vote concerning an indictment. Not saying it wasn't shortly before the end of the GJ, but we can't tell from ST's statement. Afterall, Hunter, Kane, and just about everybody had said from day 1 that the GJ was investigative, not called for the purpose of indicting. Second, as I understand it, the GJ uses a "probable cause" criterion for voting for a true bill. As ST indicated, there was no disagreement anywhere as to whether than standard could be met - even before the GJ. The issue has always been whether they had a strong enough case to take to court and expect to win. A GJ vote would not address that; that is a decision Hunter & his aides would have to make, even after a true bill vote. Why ask the GJ to vote if you already know there is probable cause, but you don't have a strong enough case to justify going to trial? I'm not saying the conclusion that the case was too weak for trial was necessarily the right one. That definitely was the feeling of even Beckner prior to the GJ, but maybe new evidence changed that. Criticizing Hunter for not going to trial might have some merit, but doing so for not asking for a vote is pretty questionable, IMO. Third, perhaps it would be appropriate to cut the Boulder populace some slack concerning "wanting to move on." All indications are that the case is not sufficient to expect a win in court. Most commentators have also been pretty pessimistic about whether that will ever change. Facing that situation, why not "move on" rather than continue to flog the nag? That doesn't mean the case needs to be completely forgotten and never worked on by the police, but just that it doesn't have to be the dominant, everpresent issue anymore. So from the beginning the GJ was all about furthering the investigation and never about voting yea or nay for indictments? News to me. The stinky, crappy thing about all this : Hunter and the Ramseys all continue to imply that they were vindicated by the GJ. Nobody says what REALLY happened -- that's all secret and protected information. The Ramseys and Hunter simply point out the GJ spent all that time and all that attention looking at the Ramseys but didn't choose to charge the Ramseys with anything. "Some people" Posted by lake on 16:34:03 7/27/2000 Cannot or choose not to understand the difference between probable cause and evidence that can sucessufully prosecute and reasonably be expected to yeild the probable truth of a crime. There was probable cause to arrest both the Ramsey parents in ealy 1997. But if you arrest someone on probable cause, there should be a reasonable expectation that someone can be successfully prosecuted after the arrest if charges are filed by the DA. But, the more the case was investigated and the more the evidence that was collected was tested, the less clear the evidence of the guilt of anyone became to right thiking people. So after 3 years of investigation (including a GJ proceeding) all the evidence that was evidence should have been tested and avaiable to the GJ. All the witness and other interview and statements were known. It was not going to get any better after the GJ wrapped up. And there was not a clear cut case against anyone was the judgement of the DA and his independent advisors. Probable cause did not count in 10/99. There was no real further investigating to be done or evidence to be collected. It was as good as it was going to get and the evidence did not support filing charges against anyone. And, that it the way it is. For a DA to ask or allow a GJ to return an indictment on probable cause standards that no longer appllied to the situation after a 3 year investigtion is just a plain dumb. And for anyone to take seriously the claims to ST regarding things turning out differently if the DA would have gone along with a probable cause arrest is just pie in the sky. The odds are that the Rs would have been out on bail in 24 hours, would have had a damn good excuse for not cooperating with the cops, the Ramseys would have looked better in the eyes of the public and the cops would have looked like even bigger fools.
