Wood said Thomas has made incriminating statements against his clients in the book, "JonBenét: Inside the Ramsey Murder Investigation," while promoting it. Question about depositions... will LW be allowed to ask Thomas anything he feels like asking him, or is he required to stick to question pertinent to the Chris Wolfe case? His attorney can enter objections to some questions, but Steve may still answer the questions. There may be some questions Steve's attorney advises him NOT to answer, and I don't think he has to if they are going to infringe upon his right to remain silent because of his own case. I'm wondering how this will apply to information Steve Thomas may have that he has never released, not even in his book, and which has never been released to the public. It is my belief that the judge is wrong if she is allowing LimpWood to go on a fishing expedition with Thomas as a means of getting to information on evidence as yet unknown to the Ramseys. It would surprise me if there were still evidence they don't know about, given their little snitches in the DA's office at the time, but there still could be something that has never been released to the public that ST knows about. In spite of the judge's order that Thomas answer all questions relative to the murder, whether it pertains to the Wolf lawsuit or not, I'll bet Thomas' lawyer will instruct him not to answer those questions. I think his attorney will instruct him not to answer questions that could jeopardize his own defense strategy in Ramseys suit against him. There might be a possiblity that could lead to contempt of court charges, but they could appeal those charges to a higher court and get it out of that local judge's jurisdiction. I don't know that, I'm just talking to myself, here. There is just no way any defendent in any court has to jeopardize his own case to enrich the opposition in that same case, and I really think that judge was out of line giving an order like that. This is a civil trial and Thomas has done nothing illegal so he can't take the 5th. Can he, like you suggested, refuse to answer questions because it may interfer with his own civil trial? Obviously, Simpson was the defendent in that lawsuit, so it was understandable when his attorney told him not to answer a question, not that it did much good, sometimes - Simpson loved to talk. It also happened, though, with Paula Barberri, who was not a defendent in the lawsuit. Her attorney, I believed, told her not to answer some questions, too. That's what lawyers are for - to protect you interests. In spite of the fact that the judge said LimpWood could ask the questions, I still wonder if Thomas' lawyer would allow him to answer certain questions if they go against his own best interests. Steve Thomas objected to being deposed at all considering he was a defendent in an upcoming civil suit instigated by the Ramseys. The judge denied his motion and said he has to submit to deposition. However, that judge did not, (nor do I think she can legally do so) force him to answer every question put to him by Wood. She said he has to be deposed. If that judge could legally force him to answer every question put to him (Limpwood could conceivably ask him, did you have sex last night and he would have to answer it? The Ramseys, represented by Lin Wood, wrote a book libeling Chris Wolf, pointing to him as the killer of their daughter. Chris Wolf, represented by Darnay Hofman, brought a libel suit against the Ramseys for publishing false and libelous statements. Discovery is in progress, and so each side is now taking depositions. Depositions, by their very nature, are fishing expeditions. But you also have certain individuals/witnesses who you want on the record providing testimony and evidence to support your suit (or defense of the suit). And that's what we have here. The Ramseys called Wolf suspicious and someone they thought should be investigated for JBR's murder. They're going to depose Thomas because ST was assigned to the investigation. They want him because they want to prove that their "defamation" was supported by the fact that the BPD did, indeed, investigate allegations that Wolf was involved in the slaying. IOW, they want to prove that they didn't 'initiate' any allegations of wrongdoing or point their fingers without cause - they were merely "repeating" the fact that Wolf was a suspect at one point. (What they fail to note in their book at any time is that yes, Wolf was investigated, but cleared - which is the basis of Wolf's suit - he was cleared of all suspicion but the Ramseys led on as though he were still "under the umbrella"). Meanwhile, ST writes a book defaming the Ramseys, pointing the finger directly at them and claiming Patsy did it. The Ramseys, in turn, bring a defamation suit against Thomas. This case has nothing to do with the Wolf case. The Wolf deposition will revolve around ST's involvement in the homicide as regards the police investigation of Wolf. Lin Wood could...and probably will...try to interrogate him on matters on the homicide investigation, generally, and his involvement and evidence collection that led him to publish his defamatory remarks about Patsy. But ST's attorney will be there and can...and will...object to these questions as "outside the scope" of the case at hand. As this deposition was noticed by the Ramseys, they can be present at the deposition. As it is Wolf's suit, Wolf can be present at the deposition as well. But it's not obligatory. It is, for the attorneys; so both Lin Wood and Darnay Hofman will be present. Both will be free to ask (or object to) questions. Thomas is the deponent. He must be there and will most certainly have his attorney by his side. As he is the deponent, he is the only one who will be questioned. At no point will the table be opened, freeing either plaintiff or defendants for interrogations. And btw, they're there as observers only. Questions have to be asked of the deponent through their attorneys. That, of course, won't stop Patsy from hemming and hawing and rolling her eyes, nor will it stop John from giving his evil eye or otherwise showing his temper. Wood can go all over the board with his questions, but the only questions that will be answered will be the ones that deal with the BPD's investigation into Wolf as a suspect. and Thomas' involvement in that investigation and anything he may have heard or observed in that respect.
