Bynum's firm also happens to have been Access Graphics' legal counsel, Bynum and John Ramsey were owner's of Pasta Jay's restaurant together, Bynum is all over the JBR Foundation and Ramsey real estate, and Bynum and friends orchestrated the purchase of 755 15ht afetr the murder. And now DeMuth, a prosecutor presumably in his position to seek justice, particularly for victims who can't speak for themselves, goes to work for Team Ramsey attorney Bynum? What in the hell is wrong with this picture? And why is no one in a position to do something about it doing/saying anything about this apparent, major conflict of interest? And how does this now make Hunter look? Besides the obvious (an idiot), and a horrendous horse handicapper, this just shows it all for what it was. What a sad, sorry state of affairs. In fact, let's make this a POSTERS AND LURKERS ALERT: with Will's permission, copy his post, or use that information to create your own letter, and send it to Reno, Owens, and the ABA. It's up to us. If we can't be bothered to even write a letter or email, then we are hypocrites. COPY AND/OR USE THIS, IF IT HELPS: All we're asking for is a fair and impartial investigation into "the appearance of impropriety" in Demuth's behavior in this case. In addition, this is just one more example of this "appearance of impropriety" that has plagued this case from the beginning. If the DA's Office has acted in less than rigorous representation of their clients, the People of Colorado, then they have at least broken the Canons of the ABA. Whether it can be proven that they have in fact practiced obstruction in this case needs to be rigorously investigated for the People of Colorado. If this isn't as obvious as the nose on your face, then I want to know what YOUR agenda is? Do it, people. The time is now. The Colorado press obviously is playing the cronyism game. They aren't going to push it and anger their connections. If we don't, who will? 34. I wouldn't say DeMuth "protected" the crime scene. It's just that the BPD wanted to take it down and return the home to the Ramseys prematurely. And it was DeMuth who fought to force the BPD to keep collecting evidence and preserve the crime scene as well as it could be. 43. Thomas described it this way: "As Gosage and I sat in police headquarters, Pam Paugh, one of Patsy Ramsey's sisters who had flown in from Atlanta, was staging a one-woman raid on the crime scene that I could only compare to buring the damned place down. And she did it with the help of the cops!" (p. 51) He never names names as to who gave the go-ahead on this. He probably didn't have proof, so just describes in great detail how Pam spent hours loading a police car with the Ramsey's possessions. This ostensibly started out as a trip to get some funeral clothes. "The patrol car was loaded with zipped bags, boxes, sacks, and luggage, the true contents unknown...and the police were only in their second day of the official search of the house."(p. 52) "Later that afternoon...Arndt and Trujillo were advised by Deputy DA Pete Hofstrom that the Ramseys had now both retained counsel and would not consent to an interview with the police at this time. Hofstrom then suggested the detectives submit written questions.... Hofstrom further advised that the Ramsey attorneys wanted to review all case information before allowing cops access to their clients.... When Detective Arnedt was prepared to reply to Hofstrom, she dialed a telephone number where he said he could be located. It was the law office of Ramsey attorney Mike Bynum." (p.53-54) If the people of Boulder don't give a rip about this level of corruption, I don't care. Jonbenet deserves better, and I for one am not just going to sit here and heave and sigh about it. What about all you out there who claim to be journalists? Don't you have some connections? Can't you get this in the news? Anyone know any Geraldo producers? What about McKinley? She does MSNBC. Where is she? Where's Abrams? The Olympics will end one day. Let's hear some real news being reported! Because if there is not a roar and outcry over this, then we know you are not interested in a murdered little girl, but just in making connections and promoting yourself at her expense. There are about 5 more Canons that he also put into questionable light, but there is no question Demuth's taking this job was unethical. Going to work for attorneys for the prime suspects in a major case after working as a prosecutor in that case for 4 years, especially when your actions in that case have already been called into question, is about as self-serving and unethical as it gets. It is so brazen it demonstrates a complete lack of respect for the law and the ABA's own ethics. More egregious than that, it is disrespectful of JonBenet. Demuth is essentially saying she does not deserve the full measure of independent legal representation any client is assured by: Canon 5 -- A lawyer should exercise independent professional judgment on behalf of a client. There's also: Canon 4 -- A lawyer should preserve the confidences and secrets of a client. (See Dunvegan's post #16 if you believe Demuth won't be putting this Canon in jeopardy.) Canon 7 -- A lawyer should represent a client zealously within the bounds of the law. If he had represented her zealously, Bynum wouldn't be extending an offer of employment to him, as JonBenet's attorney, and the Ramsey's adversary. This group of lawyers has done more to comfirm all our worst fears about lawyers than any since the O.J. trial. My only problem with the letters is this: It seems possible demands are being made without really knowing all the facts. First deMuth If he wanted to continue his career in the legal profession by working as a defense attorney ... in Boulder, his choices would all, necessarily, be restricted to firms that have been on the opposite side of the courtroom. While the Ramsey case is the one that interests us, it isn't the only case in Boulder, and I'm not sure it would be a big factor in his decision. He isn't a young attorney, just starting out, so this may have simply been a career choice. IOW, perhaps Bynum (sp ?) just made him the best offer. Maybe it only looks like he made an unethical move to people who are very focused on this case. Alex Hunter I'm not real sure how this works in Colorado. My two sons are lawyers and my daughter-in-law, (which I've probably mentioned before.) I can tell you that they don't really get emotionally involved with their cases. It's not like TV. Some change firms often, some don't. It's not unsual to go from prosecution to defense, for example, because there's more money in it. The cases involved would have nothing to do with the change. Many lawyers get their training in the DA's office and then move into their own practice or another law firm. Law firms are all on the defense side. In a small town, there may not be a lot to choose from. But, even in a big city, it could happen, and has really nothing to do with loyalty to any one case, especially if the case is not really ongoing. That Bynum's firm doesn't deal in criminal law only goes to any conflicts of interest as regards clients -- be they defendants in state cases DeMuth was involved with, or not. Those conflicts are supposed to be cleared, and released, prior to DeMuth's hiring. Since this firm didn't represent the Ramseys, this type of conflict wouldn't exist. However.... There is a conflict in that Bynum was a personal friend of Ramsey, as well as legal counsel to Ramsey's company, Access Graphics. It conflicts with DeMuth's participation and involvement with his investigation as an Asst DA. Likewise, upon leaving the employ of the DA's office, DeMuth should have been required to execute a confidentiality agreement whereby he's gagged for a period of time (usually up to 5 years) to speaking of any cases he was involved with. This conflicts with his employ and friendship with Bynum. So keep up your campaign! Colorado should have a state bar association and should be added to your list in addition to the ABA. About Steve Thomas ... he certainly has a right to promote his theory, since the precedent has already been set (although I fear his book can only hurt any possibility of prosecution in this case). To my knowledge, Gov Owens is the only person who can step in and do something about Hunter and his corrupt lackeys. Yet he has done nothing. As for Reno, Mr Hoffman contacted Reno in 1998 asking that she intervene. I myself even wrote Reno after I read his story, thinking that another voice would help. As you see, Reno has done nothing. I even wrote the President after that piece of crap Hunter wimped out after the GJ. And I wrote the Gov AGAIN after Thomas' book revealed all of the obstruction of justice allegations. They have done NOTHING. The only hope, ONLY HOPE, this case has rests upon the outcome of the election. If Keenan goes in, it is all over. period. If Sanderson goes in, I am told that he will push this case into the courtroom. I have no idea if he will but from what I have read about him i believe he will give it his best shot. If nothing else, I believe Sanderson will get a huge broom and sweep those lowlifes out of the DA's office and start anew. I really do think you are making an outstanding effort in trying to thump up some attention from those with the power to give the case a push. OK ... say it's a case that hasn't made it to trial yet, but in which there has been an arrest. That would mean the DA's office would be actively working on a prosecution. What if DeMuth ... obviously a lame duck, like Hunter, because we can be pretty sure neither of the current candidates are going to ask him to stick around ... accepted an offer with a firm representing the defendant in that case. Would you still be upset? From reading many, many posts over the past ... forever, it sometimes seems ... I've come to believe we DO tend to hold those within this investigation to a much stricter level of conduct than we would if the same situation applied to some other criminal investigation. That's all. My best suggestion would be to contact some people who are in the profession in CO, and who could tell you just what would and would not be considered a breach of the code of ethics. You could be right, but I'd rather double check than swamp these folks with subjective opinion they'll just shrug off.
